The Pennsylvania Supreme Court has ordered that all general election ballots that are mailed in undated or incorrectly dated envelopes must be set aside and not counted by election commissions.

“We hereby order that the Pennsylvania County Election Commissions segregate and retain all ballots contained in undated or incorrectly dated outer envelopes,” the court said in an order Tuesday in response to a lawsuit. the Republican National Committee, the Republican Congressional Committee, and the Republican Party of Pennsylvania.

Pennsylvania requires voters to sign and date the outer envelope when mailing in a ballot.

In the deadlocked 3-3 order – a place on the bench remains vacant after the death of the chief justice – the court acknowledged that it was “evenly divided” on whether the failure to counting undated or incorrectly dated ballots was a violation of federal election law. Three judges said they would find a violation of federal law, while three judges said they would find no violation.

The case is the result of the lawsuit filed by state and nationwide Republicans last month that alleged Pennsylvania’s acting Commonwealth Secretary was bypassing the General Assembly by telling county councils to count returned ballots. in a timely manner, but without a dated envelope.

The two-page order did not provide any details of the judges’ reasoning, stating only that the notices would be released later.

“This decision is a massive victory for Pennsylvania voters and the rule of law,” RNC Chair Ronna McDaniel said in a statement. “Republicans went to court, and now Democrats and all counties must obey the law: This is an important step in Republicans’ ongoing efforts to make it easier to vote and make it harder to cheat in Pennsylvania and across the country. .”

Pennsylvania does not begin processing mail-in ballots until Election Day.
